An unsuccessful attempt by the Racing and Wagering Committee of the New York State Assembly to enact a bill that would have allowed Vernon Downs and other racinos in New York to pay lower taxes to the state resulted in the closure of the casino on February 11, 2008. In a short amount of time, legislation was passed, and three days later, the casino was reopened by its owners.
Following the discovery of a proven case of equine herpes at the track in 2013, the New York Gaming Commission made the decision to cease live racing at the venue.
